Service Connection

 

Under VA law, there are five different legal theories to utilize, which can prove that your disability is linked to service. 

Increased Ratings & Effective Dates

If your service-connected disability has worsened you may be entitled to an increased rating. It is important to assess your earliest effective date, which may be the date that the disability increased in severity.

PTSD & Mental Health Disorders

There are eight categories of mental disorders: schizophrenia and other psychotic disorders; delirium, dementia, amnestic and other cognitive disorders; anxiety disorders (including PTSD); dissociative disorders; somatoform disorders; mood disorders; chronic adjustment disorder; and eating disorders.

 

Total Disability based on Individual Unemployability (TDIU)

 

If you cannot secure or maintain substantially gainful employment because of your service-connected disabilities, you may be entitled to a 100% rating. 

Clear and Unmistakable Error

If you feel like the VA issued an unfavorable decision based on a clear or unmistakable error (CUE) you may be able to argue that the decision should be reversed or revised. A CUE claim is very powerful because it allows you to establish your effective date on the date of the prior decision, even if it has been years since you noticed the error.

Toxic Exposure

 

You may be entitled to benefits if you were exposed to water contamination at Camp Lejeune; burn pits in Iraq, Afghanistan, and Djibouti; or Agent Orange in the Republic of Vietnam, the Korean DMZ, or certain Royal Thai Air Force bases. Contact me to find out more.

Gulf War Syndrome

 

If you served in the Persian Gulf War in the early 1990s or in Operation Iraqi Freedom after September 11, 2001, you may be entitled to benefits for certain medically unexplained chronic multi-symptom illnesses (such as fibromyalgia, chronic fatigue syndrome, and irritable bowel syndrome), as well as certain infectious diseases.
